Before placing an order with Caldria Home, please read these Terms & Conditions. By using this Website or submitting an order, You agree to the terms below.
ATTENTION
This document is a binding agreement between You — the individual or entity accepting these terms ("You," "Your," or "Customer") — and Kova Tech LLC, doing business as Caldria Home ("We," "Us," "Our," or "Company"). You and the Company are together referred to as the "Parties." This Agreement, together with the Privacy Policy and any policies linked from it, governs access to and use of caldriahome.com (the "Website"), its content, and its storefront functions.
ACCEPTANCE OF TERMS OF USE
By visiting, browsing, or using the Website, You agree to this Agreement and Our Privacy Policy. If You do not accept these terms, stop using the Website. Continuing to browse or selecting a button such as "Place order," "Submit," or similar wording confirms Your acceptance.
This Agreement is the entire understanding between You and Caldria Home concerning the Website and supersedes earlier discussions on the same subject. It is intended to be enforceable under applicable electronic-signature law. We recommend saving or printing a copy for Your records.
You may not use the Website in violation of any applicable law. The last-modified date at the end identifies the current version. Revised terms apply when posted, subject to rights that cannot legally be waived.
Credit Card Descriptor
Card fields displayed by the Website are validated locally in Your browser. The Website does not currently transmit card data to Kova Tech LLC, connect to a payment processor, or create a card-statement charge. If payment processing is connected, the applicable descriptor will be disclosed as caldriahome.com, and these Terms will be updated before live charges are accepted. Questions about any separately confirmed charge should be directed to Our customer service team.

All prices are listed in U.S. dollars. Product availability, descriptions, dimensions, materials, care information, and prices may be corrected before an order is separately accepted. Taxes, if applicable, will be disclosed before an operational transaction is confirmed.
Delivery Cost
Standard USPS shipping is free for accepted orders. Our stated preparation time is 3–5 business days. Carrier transit times vary by destination, weather, service interruptions, holidays, and other conditions outside Our control. When an accepted order ships through an operational fulfillment process, tracking information will be provided using the contact details associated with that order.
Refund Policy
A fraudulent or unauthorized charge connected to an operational transaction should be reported promptly by calling +1 (337) 245-0188. Rights provided by card issuers and applicable law remain unaffected.
For accepted orders, You may request a refund within 30 days of delivery. We may require Your name, delivery address, order reference, photographs, or other information reasonably necessary to evaluate the request. Approved refunds are returned to the original payment method after review and may take up to 15 business days to appear, depending on the financial institution.
Refund requests may be declined where an item has been damaged through misuse, altered after delivery, returned incomplete, or submitted fraudulently or repeatedly in bad faith. Nothing in this section limits non-waivable consumer rights.
Return Policy
Before sending an item, contact customer service for return instructions and, when required, a Return Merchandise Authorization number. Unless the item arrived damaged, defective, or incorrect, it must be returned unused, in its original condition, and with original packaging where applicable. Return shipping is the Customer's responsibility unless We confirm otherwise in writing.

The fulfillment address is used for shipment preparation and is not automatically an authorized return destination. Returns sent there without instructions may be delayed or refused.
Shipping Terms
Accepted orders are prepared in the quantity confirmed and within the stated 3–5 business days preparation window, then tendered to USPS. Packages generally do not leave the fulfillment facility on Saturdays, Sundays, or carrier holidays. We cannot guarantee an exact delivery date or time and are not responsible for carrier delays outside Our reasonable control.

LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTY
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, ITS CONTENT, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OTHER THAN THOSE EXPRESSLY STATED OR REQUIRED BY LAW. Caldria Home AND Kova Tech LLC DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT TO THE EXTENT THOSE WARRANTIES MAY LAWFULLY BE DISCLAIMED.
TO THE FULLEST EXTENT PERMITTED BY LAW, Caldria Home, Kova Tech LLC, AND THEIR OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE WEBSITE, THIS AGREEMENT, THE PRIVACY POLICY, OR ANY PRODUCT, WHETHER THE CLAIM SOUNDS IN CONTRACT, TORT, STRICT LIABILITY, WARRANTY, OR ANOTHER THEORY.
WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL CODE; THAT ALL DEFECTS WILL BE CORRECTED; OR THAT EVERY DESCRIPTION, IMAGE, DIMENSION, COLOR, OR OTHER PIECE OF CONTENT WILL BE PERFECTLY ACCURATE ON EVERY DEVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR A CLAIM WILL NOT EXCEED THE LESSER OF USD $500.00 OR THE AMOUNT ACTUALLY PAID TO US BY YOU DURING THE ONE MONTH BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not permit particular warranty exclusions or liability limitations. In those jurisdictions, the exclusions and limitations above apply only to the maximum extent permitted. Nothing in this Agreement excludes liability or consumer rights that cannot legally be excluded.
REPRESENTATIONS
We aim to provide accurate information about product materials, dimensions, finish, installation, use, and care. Product photographs may appear different across displays, and natural, handmade, ceramic, glass, textile, wood, or finished materials can include reasonable variation. Website specifications and third-party information are provided for general guidance and do not guarantee that every item will be identical in color, grain, texture, or measurement.
Follow all included instructions and ordinary safety practices. Keep candles away from drafts, children, pets, and combustible materials; mount mirrors using hardware and wall support appropriate to the surface; use lighting only with the specified socket and wattage; and stop using any product that appears damaged. Results from styling, lighting, placement, or care vary by environment and use.
By using the Website, You agree to follow applicable U.S. laws and regulations. Website content is protected by United States copyright and trademark law and applicable international treaties. We do not represent that the Website is appropriate or lawful in every jurisdiction. If You access it outside the United States, You are responsible for local-law compliance.
Use of Individual Information
We do not sell personal information. Cart product identifiers and quantities are stored only in the current browser-tab session so the cart can survive navigation and page reloads. Checkout, address, contact, newsletter, and payment fields are not transmitted to Kova Tech LLC by the current Website interface. The hosting provider may process limited technical request logs under its own policies. See Our Privacy Policy for full details.
YOUR REPRESENTATIONS
By using the Website, You represent that You are at least eighteen years old or have the involvement of a parent or legal guardian where permitted. You agree not to post or transmit unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or privacy-invasive content; impersonate another person or organization; introduce malware or disruptive code; interfere with the Website or connected infrastructure; attempt unauthorized access; or violate applicable local, state, national, or international law.
Without prior written permission, You may not copy or commercially reuse the Website; create derivative works from protected content; remove ownership notices; frame the Website; use hidden metadata based on Our names or marks; bypass security measures; scrape or mine data with automated tools; or impose an unreasonable load on the Website or its infrastructure.
TERMINATION OF AGREEMENT
This Agreement remains effective while You access or use the Website. We may suspend access, terminate this Agreement, decline a separately submitted order, or refuse service where We reasonably believe a user has violated these Terms, misused the Website or products, attempted fraud, or failed to provide information reasonably needed to verify an operational transaction. Provisions that by their nature should survive termination remain effective.
INDEMNITY
To the extent permitted by law, You agree to defend, indemnify, and hold harmless Caldria Home, Kova Tech LLC, and their affiliates, officers, members, employees, contractors, service providers, and agents from claims, losses, liabilities, expenses, and reasonable legal or accounting fees arising directly from Your unlawful misuse of the Website, Your violation of another person's rights, or Your material breach of this Agreement. We will provide reasonable notice of a covered claim and may participate in its defense.
DISPUTE RESOLUTION BY BINDING ARBITRATION
Before filing a formal claim, each Party agrees to send the other a written explanation of the dispute, relevant documents, and a proposed resolution, and to attempt resolution in good faith for at least 30 days. Notices to Us must be sent to Kova Tech LLC – Caldria Home, 201 Rue Beauregard, Suite 202, Lafayette, LA 70508, USA. We will respond using the contact information available from the relevant correspondence or separately accepted transaction.
Where the Parties mutually agree or applicable terms validly require it, a dispute may be submitted to binding individual arbitration under applicable law. This section does not prevent either Party from seeking relief in small-claims court where eligible, reporting a matter to a government agency, or pursuing injunctive relief for misuse of intellectual property or unauthorized access. Mandatory consumer protections remain unaffected.
No Trial By Jury
TO THE EXTENT PERMITTED BY LAW AND FOR CLAIMS NOT PROPERLY BROUGHT IN SMALL-CLAIMS COURT, EACH PARTY WAIVES THE RIGHT TO A TRIAL BY JURY.
No Class Actions
TO THE EXTENT PERMITTED BY LAW, CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THIS PROVISION DOES NOT APPLY WHERE SUCH A WAIVER IS PROHIBITED.
GOVERNING LAW
This Agreement and disputes connected to it, the Website, Our intellectual property, or Our products are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles, except where mandatory law requires otherwise.
SEVERABILITY
If a court or other authority finds any provision invalid or unenforceable, that provision will be enforced to the greatest extent permitted or removed to the minimum extent necessary, and the remainder of this Agreement will continue in effect.
NO WAIVER
A failure or delay in enforcing any provision is not a waiver of the right to enforce that provision later. A waiver is effective only if made in writing by an authorized representative of Kova Tech LLC.
HEADINGS
Section headings are provided for convenience only and do not affect interpretation.
COMPLETE AGREEMENT
This Agreement, together with the Privacy Policy and any policies expressly incorporated by reference, is the complete understanding between the Parties concerning access to and use of the Website and any separately accepted purchase, replacing earlier written or oral agreements on the same subject.
